Privacy Policy

1. Who this policy covers

This policy applies to kdgm.com.au and to Kurgel Pty Ltd, ACN 161 536 036, trading as Kurgel Digital Marketing, of 100 Bulla Road, Essendon Fields VIC 3041. We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).

2. What we collect

2.1 When you send an enquiry

Your name, business name, email address, phone number if you give it, what you sell and where, your approximate current ad spend, and anything else you write in the message.

2.2 When you book a call

Your name, email address, phone number and the time you select. Collected by our booking provider.

2.3 When you visit the site

Your IP address, browser and device type, the pages you view, how you arrived, and the date and time. We do not currently run Google Analytics or an advertising pixel on this site. If that changes, this policy will be updated before they go live.

2.4 If you become a client

The information needed to run and invoice the engagement, including billing details and access to the advertising accounts you authorise.

We do not collect sensitive information as defined by the Privacy Act, and we ask you not to send it.

3. How we collect it

Directly from you, through the enquiry form, the booking page, email or phone. Automatically through our website hosting and, if enabled, analytics. Occasionally from publicly available sources such as your own website when preparing for a call.

4. Why we collect it

• To reply to you.
• To work out whether we can help and what an engagement would cost.
• To deliver the work if you become a client.
• To understand which pages and campaigns bring people to the site.
• To meet our tax and record-keeping obligations.

If you do not give us the information we ask for, we may not be able to respond usefully.

5. Cookies and tracking

No analytics or advertising cookies are currently set by this site. The only cookies used are the ones needed for the site to work.

6. Who else sees it

• Our website host and form provider.
• Our booking provider.
• Our email provider.
• Our accounting and invoicing software.
• Advertising and analytics platforms, where enabled.
• Professional advisers where we are required to disclose.

Some of these providers store data outside Australia, including in the United States and the European Union. By submitting information you consent to that transfer. We take reasonable steps to use providers with appropriate protections, but we cannot control an overseas provider in the way Australian law would.

We do not sell your personal information. We do not trade or rent contact lists.

7. Marketing messages

We only send commercial email or SMS where you have asked for it or where you are a client and it relates to your engagement. Every commercial message carries an unsubscribe option and our postal address, as required by the Spam Act 2003 (Cth). Sending an enquiry does not put you on a mailing list.

8. How long we keep it

• Enquiries that do not become clients: two years, then deleted.
• Client records: seven years after the engagement ends, as required for tax and record-keeping.
• Analytics data: for the period set by the provider.

9. Keeping it secure

We take reasonable steps to protect personal information from misuse, loss and unauthorised access, including access controls on the systems that hold it. No system is completely secure, and we cannot guarantee the security of information sent to us over the internet.

10. Getting your information, or having it corrected

You can ask us what personal information we hold about you and ask us to correct it. Send the request through our contact form, by email to hello@kdgm.com.au, or by post to the address in section 15. We will respond within 30 days. We may need to verify who you are first. In limited cases the law allows us to refuse — if we do, we will tell you why in writing.

11. Having it deleted

You can ask us to delete your personal information. We will do so unless we are required to keep it — for example, client billing records we must hold for tax purposes. Send the request through our contact form, by email to hello@kdgm.com.au, or by post.

12. Making a complaint

If you think we have mishandled your personal information, tell us first — through our contact form, by email to hello@kdgm.com.au, or by post to Kurgel Pty Ltd, 100 Bulla Road, Essendon Fields VIC 3041. We will respond within 30 days.

If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au, by phone on 1300 363 992, or by post to GPO Box 5288, Sydney NSW 2001.

This site links to third-party sites and platforms we do not control. This policy does not cover them. Read their own privacy policies.

14. Changes to this policy

We may update this policy. The version on this page is the current one and the date at the top shows when it last changed.
